1. Agreement to Terms
By accessing or using LandOps ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use the Service.
These terms apply to all users of the Service, including individuals and organizations accessing LandOps through any subscription tier.
2. Description of Service
LandOps is a cloud-based customer relationship management (CRM) platform designed for land investors and land acquisition teams. The Service includes tools for managing deals, contacts, campaigns, documents, dispositions, and team workflows.
LandOps is provided as a software-as-a-service (SaaS) product. Access requires an active account and, depending on your plan, a paid subscription.
3. Account Responsibilities
You are responsible for:
- Providing accurate and complete registration information
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying LandOps immediately of any unauthorized access or security breach
- Ensuring that all team members added to your organization account also comply with these terms
You must be at least 18 years old and legally capable of entering into binding contracts to create an account. Accounts registered on behalf of a business or organization must be created by an authorized representative.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Transmit spam, unsolicited messages, or bulk communications without proper consent
- Harass, threaten, or harm individuals whose information is stored in the system
- Upload or distribute malware, viruses, or any malicious code
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use automated means (bots, scrapers) to access or extract data from the Service without prior written authorization
- Resell or sublicense access to the Service without written permission from LandOps
- Circumvent any security, access control, or rate-limiting feature of the platform
You are solely responsible for compliance with applicable laws when using LandOps to contact property owners, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state regulations.
5. Data Ownership
You retain full ownership of all data you upload, create, or store within LandOps ("Your Data"). This includes deal records, contact information, notes, documents, and any other content you introduce into the platform.
By using the Service, you grant LandOps a limited, non-exclusive license to store, process, and display Your Data solely for the purpose of providing and improving the Service. We do not sell Your Data to third parties.
You may export your data at any time through the platform's built-in export tools or by contacting support. Upon account termination, you will have a 30-day window to export your data before it is deleted from our systems.
6. Service Availability
LandOps operates on a best-effort basis. We aim for high availability but do not guarantee any specific uptime service level at this time. Scheduled maintenance, infrastructure outages, or third-party dependencies may cause temporary interruptions.
We will make reasonable efforts to provide advance notice of planned downtime. LandOps is not liable for losses, damages, or business disruption caused by service unavailability.
7. Fees and Billing
Paid subscription plans are billed in advance on a monthly or annual basis. All fees are in US dollars. By providing a payment method, you authorize LandOps to charge the applicable fees on your selected billing cycle.
Subscription fees are non-refundable except as required by law or as explicitly stated in a separate agreement. Downgrading your plan or removing seats mid-cycle does not entitle you to a prorated refund for the unused period.
LandOps reserves the right to change pricing with 30 days' advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
8. Termination
Either party may terminate the relationship at any time. You may cancel your subscription through your account settings or by contacting support.
LandOps may suspend or terminate your account for material breach of these terms, non-payment, or activity that poses a legal, security, or reputational risk to the platform or its users. We will make reasonable efforts to notify you before termination unless the breach is severe.
Upon termination, your right to access the Service ends immediately. Data export is available for 30 days post-termination. After that window, your data may be permanently deleted.
9. Intellectual Property
LandOps and its underlying technology, branding, and platform features are owned by LandOps. Nothing in these terms grants you ownership of any LandOps intellectual property.
Feedback, suggestions, or feature requests you submit may be used by LandOps to improve the Service without compensation or attribution.
10. Limitation of Liability
To the maximum extent permitted by applicable law, LandOps and its officers, directors, employees, and contractors shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from your use of or inability to use the Service
- Unauthorized access to or alteration of your data
In no event shall our total liability to you for all claims exceed the greater of (a) the fees you paid to LandOps in the twelve months preceding the claim, or (b) $100 USD.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
LandOps does not warrant that the Service will be error-free, uninterrupted, or free of harmful components.
12. Governing Law
These terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be resolved in the courts of Florida.
13. Changes to These Terms
LandOps may update these Terms of Service from time to time. When we make material changes, we will notify you via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised terms.
